Acceptance of Terms
These Terms of Service (“Terms”) govern all orders placed and all use of jelqgym.com (the “Site”), operated by PowerJGym® (“we,” “us,” or “our”). By browsing the Site, creating an account, or placing an order, you (“customer,” “you”) confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Site or place an order.
Orders & Payment
All orders placed through the Site are subject to acceptance and availability. Payment is processed securely at checkout through our approved payment providers; your order is confirmed only once payment has been successfully received and authorized. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or payment failure — in which case any amount charged will be refunded in full.
Prices are listed in U.S. Dollars (USD) and do not include applicable customs duties, import taxes, or fees, which are the responsibility of the customer as described in Section 3 below.
Shipping & Delivery
Once payment has been confirmed, your order is dispatched for delivery to any address worldwide. By placing an order, you acknowledge that your purchase may constitute a non-local or international sale and that additional customs, import duties, taxes, or carrier handling fees may apply upon arrival in your country; these charges are outside our control and are the sole responsibility of the customer.
Shipping rates and delivery times: Shipping is free on all orders delivered within the United States, with an estimated delivery time of approximately 5 business days. International orders ship for a flat rate of $14 USD, with an estimated delivery time of approximately 10 business days.
Estimated delivery times are provided for guidance only. Delays caused by couriers, customs authorities, weather, or other circumstances beyond our control may occur; such delays do not cancel, invalidate, or entitle the customer to void an order that has already been dispatched. We are not liable for delays once a shipment has left our facility, though we will assist in tracking and resolving delivery issues in good faith whenever possible.
Returns & Refunds
You may return a product within 30 days of delivery. To start a return, please contact us in advance to receive return authorization and instructions. Returned items must be unused, in their original condition, and in their original packaging unless the return is due to a manufacturing defect.
Approved refunds are issued to the original payment method once the returned item has been received and inspected. Processing times may vary depending on your bank or payment provider.
Eligibility
Our products are intended for use by adults only. By placing an order, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) and that you have the legal capacity to enter into a binding agreement under these Terms.
Product Use & Liability
The Power J Gym® PJG3 and all related products are designed for personal exercise use only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. By purchasing and using this product, you acknowledge and accept that you do so entirely at your own risk, and that you are responsible for following the included User Manual and all safety notices contained within it.
We strongly recommend consulting a qualified healthcare professional before beginning any new exercise routine, particularly if you have a pre-existing medical condition. We assume no liability for injury, discomfort, or damage resulting from misuse, unauthorized modification, or failure to follow the provided instructions.
Intellectual Property
Power J Gym® is a registered trademark, and the PJG3 device incorporates utility patent-pending technology. All content on this Site — including text, graphics, product photography, videos, and the User Manual — is the property of PowerJGym® and is protected by applicable copyright, trademark, and patent laws. Unauthorized reproduction, duplication, distribution, or reverse engineering of our products or content is strictly prohibited and may result in legal action.
Limitation of Liability
To the fullest extent permitted by applicable law, PowerJGym® and jelqgym.com shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase, delivery, or use of our products, including but not limited to shipping delays, customs charges, or personal injury resulting from improper use. Our total liability for any claim relating to a purchase shall not exceed the amount paid for the product giving rise to the claim.
Governing Law
These Terms are governed by and construed in accordance with the laws applicable to our place of business, without regard to conflict-of-law principles. Where mandatory consumer protection laws of your own country of residence grant you additional rights, those rights remain unaffected by these Terms.
